1. Agreement to terms

Welcome to KibbeTypes (“we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of our website at kibbetypes.com (the “Site”), its subdomains, and the services, features, content, and applications offered by KibbeTypes (collectively, the “Services”).

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Services.

We may update these Terms at any time. When we do, we will revise the “Last updated” date at the bottom of this page. If you continue to use the Services after the changes take effect, you accept the revised Terms.

2. Eligibility

By using our Services, you represent and warrant that:

• You are at least 13 years old if you are in the United States, or at least 16 years old if you are in the European Union
• You have the legal capacity to enter into a binding agreement
• Your use of the Services does not violate any applicable law or regulation

If you are accessing the Services on behalf of a company or other entity, you represent and warrant that you have the authority to act on behalf of that entity and to bind that entity to these Terms.

3. Service description

KibbeTypes offers information and tools designed to help you explore a personal style profile, including:

• Educational guidance about Kibbe style profiles
• A quiz designed to suggest a style profile
• Clothing and styling guidance for each profile
• Curated product recommendations linked to retailers

Our Services are offered for information and entertainment. We do not provide professional fashion consulting, personal styling, or image consulting.

4. User conduct

When using our Services, you agree not to:

• Violate any applicable law, regulation, or these Terms
• Use the Services for any illegal purpose or to promote illegal activities
• Impersonate any person or entity or misrepresent your affiliation with a person or entity
• Interfere with or disrupt the Services or servers or networks connected to the Services
• Attempt to gain unauthorized access to any part of the Services or any accounts, systems, or networks
• Use any automated means to access or collect data from the Services
• Circumvent, disable, or otherwise interfere with security features of the Services
• Introduce any viruses, trojan horses, worms, or other malicious code
• Copy, modify, distribute, sell, or lease any part of the Services without our permission
• Reverse engineer, decompile, or attempt to extract the source code of the Services

We reserve the right to terminate your access to the Services immediately, without prior notice or liability, for any reason, including a breach of these Terms.

5. Intellectual property rights

Unless otherwise indicated, the Services and all content and materials available through the Services, including but not limited to text, graphics, logos, images, videos, and software, are the property of KibbeTypes or our licensors and are protected by copyright, trademark, and other intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited license to access and use the Services for personal use. This license is not exclusive. It may not be transferred, sublicensed, or used commercially. It does not include:

• Any resale or commercial use of the Services or their contents
• Any collection or use of any product listings, descriptions, or prices
• Any derivative use of the Services or their contents
• Any downloading or copying of account information for the benefit of another merchant
• Any use of data mining, robots, or similar data gathering and extraction tools

All rights not expressly granted to you in these Terms are reserved and retained by KibbeTypes or our licensors.

6. Affiliate disclosure

KibbeTypes is a participant in the Amazon Services LLC Associates Program, an affiliate advertising program designed to provide a means for sites to earn advertising fees by advertising and linking to Amazon.com.

Some recommendations include affiliate links. If you follow one and make a purchase from the retailer, we may receive a commission. These relationships do not determine our style guidance. We choose recommendations for their relevance and potential value to our readers.

KibbeTypes also participates in Rakuten Advertising for specifically approved retailer partnerships. Every public product action first passes through a KibbeTypes controlled link. A quiz result email you request may include one clearly disclosed, reviewed Rakuten recommendation. We do not include Amazon product links in result email.

Commercial terms may help order otherwise comparable recommendations, but they do not override relevance, product evidence, freshness, availability, safety, or editorial quality. We do not present synthetic reviews, unsupported health or performance claims, misleading urgency, or price and availability claims the retailer data does not support. Retailers control purchase terms, price, inventory, delivery, and returns.

7. Advertising and content from other companies

Our Services may display advertising, including Google Ads and ads from other companies. An ad is a paid placement, not an endorsement or recommendation from KibbeTypes. We are not responsible for the content, accuracy, or reliability of an ad or a website operated by another company.

Depending on your region and privacy choices, ads may be tailored to your interests, shown without personalization, limited, or not shown. You can manage these choices in our Privacy preferences. Some ads may still appear when allowed by law and your privacy choices.

Our Services may also link to websites, resources, or services we do not operate. These links are offered for convenience and information. We do not control their content and accept no responsibility for them or for any loss or damage that may arise from your use of them.

Your interactions with websites operated by others, including payment and delivery of goods or services and any related terms, conditions, warranties, or representations, are solely between you and that other party. We shall not be responsible or liable for any loss or damage of any kind resulting from those interactions.

Product names, retailer marks, images, and other supplied materials remain the property of their respective owners. KibbeTypes uses them only as permitted for the applicable recommendation and does not imply endorsement by a retailer, Rakuten Advertising, Amazon, David Kibbe, or any trademark owner.

8. Quiz data and email communications

Our Site includes a quiz designed to suggest a Kibbe style profile. When you take the quiz, we collect the sequence of your answers, your suggested profile, and the time spent completing it. We remove raw answers and any links between results and email addresses after 30 days. Combined information about results and completion time may remain without identifying you so we can improve the Services.

Submitting the quiz records this information as described in our Privacy Policy.

If you ask to receive your quiz result by email, we will send one message containing that result. We send marketing messages only if you explicitly choose to receive them. You can unsubscribe from marketing at any time. This will not prevent us from sending a result email that you request later through our Email preferences page.

The quiz offers general style guidance and entertainment, not professional advice. Its result is a suggestion, and we do not guarantee its accuracy.

9. Disclaimer of warranties

The Services are provided “as is” and “as available” without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, a warranty that the Services do not infringe the rights of others, or course of performance.

KibbeTypes and its affiliates, service providers, and licensors do not warrant that:

• The Services will function without interruption, remain secure, or be available at any particular time or place
• Any errors or defects will be corrected
• The Services are free of viruses or other harmful components
• The results of using the Services will meet your requirements

Information provided through the Services is general in nature and for informational purposes only. It is not intended to be, and should not be construed as, professional advice.

10. Limitation of liability

To the maximum extent permitted by applicable law, in no event shall KibbeTypes, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses resulting from:

• Your access to or use of or inability to access or use the Services
• Any conduct or content of any third party on the Services
• Any content obtained from the Services
• Unauthorized access, use, or alteration of your transmissions or content

This limitation applies whether the claim is based on warranty, contract, tort, including negligence, or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy stated here is found to have failed its essential purpose.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for certain types of damages. Therefore, some of the above limitations may not apply to you.

11. Indemnification

You agree to defend, indemnify, and hold harmless KibbeTypes, its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from:

• Your use of and access to the Services
• Your violation of any term of these Terms
• Your violation of the rights of another party, including without limitation any copyright, property, or privacy right
• Any claim that your actions caused damage to a third party

This defense and indemnification obligation will survive these Terms and your use of the Services.

12. Governing law and jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United States of America and the State of New York, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the state and federal courts located in New York, New York, and you hereby submit to the personal jurisdiction and venue of such courts.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions herein.

14. Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and KibbeTypes regarding our Services and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning the subject matter.

15. Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and KibbeTypes's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
